Diese ist in hohem Maße durch die Einbettung in das europäische Mehrebenensystem geprägt. Wie die vorliegende Analyse des Telekommunikationssektors zeigt, tragen die hierdurch eröffnet Interaktionsmöglichkeiten dazu bei, bekannte Probleme der Regulierung wie etwa das „regulatory capture“ zu reduzieren und staatliche Handlungsfähigkeit zu bewahren. Die regulierungsstaatlichen Strukturen zeichnen sich durch eine flexible Nutzung unterschiedlicher Jurisdiktionen sowie ihre Abhängigkeit von transgouvernementalen Netzwerken und von der Aktivierung durch private Akteure aus. The transformation from the “positive” to the „regulatory state“ in many infrastructural sectors not only leads to a change of state duties but also to modified governance structures. In this context, the institutional embedding into the European multi-level system is of special importance. The analysis of the telecommunications sector shows that this multi-level character encourages transgovernmental and transnational interactions that reduce the dangers of well-known regulatory failures, such as agency capture or principal drift. Prominent features of the evolving institutional structures are their flexible use of different jurisdictions, reliance on transgovernmental networks, and dependence on mobilisation by private actors. |
