Hat die Europäische Union eine Verfassungschance – einen historischen „constitutional moment“ – verpasst? Kann der Vertrag von Lissabon hier noch Abhilfe schaffen? Nach dem heutigen Stand der Diskussion bietet sich zumindest die Chance, über die Natur des europäischen Integrationsprozesses erneut nachzudenken. Der vorliegende Beitrag versucht dies aus einer weiten Perspektive und fragt, ob wir nach der „Epoche Hallstein“ (Europa als Friedensordnung) und der „Epoche Delors“ (Europa des Binnenmarktes) an die Schwelle eines neuen, weiter ausgreifenden europäischen Denkens gelangt sind. Welche „großen Linien“ könnten – aus Erfahrungen und Experimenten hervorgehend – ein solches Denken konstituieren? Ist die Idee des Rechts ein klärender, ergiebiger Katalysator? Did Europe enter into a crisis with the failing of the Constitutional Treaty? Did the Union miss a historic “constitutional moment”? Is the Treaty of Lisbon to be seen as an adequate remedy? Given the present state of the debate, there might be a chance to rethink the nature of the integration process. In doing so, this contribution employs a broad perspective, asking whether we are presently, following the “Hallstein era” (Europe as an order of peace) and the “Delors era” (Europe as a common market), at the edge of a new, wider European perspective. What are the basic lines that, emanating from the various experiences and experiments, could constitute such a new thinking? Could the idea of the rule of law serve as a clarifying and at the same time productive catalyst? |
