Journal for Comparative Government and European Policy Jahrgang / Volume V, Nr. / No. 2 (2007) Hans Vorländer Europas multiple Konstitutionalismen Die Diskussion über die grundlegende Frage nach Sinn und Notwendigkeit einer Europäischen Verfassung ist inzwischen wieder an ihrem Ausgangspunkt angekommen. Der damit einhergehende Stillstand ist jedoch nicht nur durch ungelöste politische Konflikt- und Machtlagen zu erklären, sondern auch durch die divergierenden Verfassungsverständnisse und -traditionen in den Mitgliedstaaten der Europäischen Union. So finden sich drei spezifische Konstitutionalismen: das historisch-evolutionäre Konzept Großbritanniens, das französische rational-voluntaristische Verständnis und die rational-juristische Tradition. Letztere hat ihren Ursprung in den Vereinigten Staaten und fand in Europa vor allem in die Verfassungen Nachkriegsdeutschlands und der mittel- und osteuropäischen Transformationsstaaten Eingang. Die sich herausbildende Ordnung der Europäischen Union wurde von allen benannten Konstitutionalismen beeinflusst, so dass es angemessen erscheint, sie auch ohne einen formellen Akt der Verfassunggebung als Verfassung zu bezeichnen. The general discussion on a European Constitution has again reached its starting point. Nevertheless, the current deadlock is not only to be explained by unresolved political conflicts, but also by the distinct constitutional traditions within the EU Member States. Three specific constitutionalisms are to be distinguished: the British historical-evolutionary concept, the French rational-voluntaristic understanding, and the rational-juridical tradition. The latter originates from the United States and has been crucial for the constitutions of post-war Germany and the transforming countries of Central and Eastern Europe. The emerging order of the European Union was influenced by all three constitutionalisms. Therefore, it seems appropriate to call it a constitution despite lacking a formal act of constitution-giving. |
